Protecting a Property Owner’s Right to Sell its Property
A small but growing church congregation voted to sell the church property and build a larger, more modern facility nearby. A small group of current and former church members opposed to the sale sued to stop it. They claimed that the deed by which the church had acquired the property prohibited a sale to anyone other than a Protestant evangelical church. In an eight-day trial, a Socius lawyer convinced the trial court to permit a sale of the property notwithstanding the deed restriction, a decision upheld on appeal.
